释义 | Quistclose信託 A special purpose trust by which it is recognised that money held by one person is held on trust for a special purpose. If the money is paid for the special purpose, the person becomes a debtor of the settlor; but if the purpose fails, a resulting or secondary trust arises in favour of the settlor. The relationships of trustee-beneficiary and debtor-creditor are not necessarily exclusive of each other: Barclays Bank Ltd v Quistclose Investments Ltd [1970] AC 567.
