Negative hearsay |
An assertion implied by producing a document or record as evidence from which the non-existence of a fact is inferred. For example, if a company adopts a system of recording the date of engagement of employees, the negative inference might be drawn that a person was never employed if no date of engagement is found. The record is now included as ‘statements’: Evidence Ordinance (Cap 8) s 55. See also Business records; Evidence; Hearsay. |
