| 释义 | 證明者 In building law, the person who makes a determination and issues a certificate in relation to a matter provided for in a building contract. In building contracts, the certifier may be given the title of ‘Architect’, ‘Engineer’, ‘Contract Manager’, or ‘Quantity Surveyor’. The certifier is frequently the contract administrator. In many building contracts, the certifier is engaged by the employer to act as its agent in the administration of the contract. Notwithstanding this, a certifier must act in a fair and unbiased manner and it must therefore be implicit in the owner’s contract with the architect that he shall not only exercise his due care and skill but also reach such decision fairly, holding the balance between the client and the contractor: London Borough of Merton v Leach (1985) 32 BLR 51; Lubenham v South Pembrokeshire DC (1986) 33 BLR 36. The test of fairness is objective.
