释义 | 經扣押的財產 Real or personal property, whether tangible or intangible, which has been taken by the authority. For example, property which represents any person’s proceeds of drug trafficking may be seized under related statute: for example Dangerous Drugs Ordinance (Cap 134); Drug Trafficking (Recovery of Proceeds) Ordinance (Cap 405). Any item seized by an police officer which he reasonably suspects to be of value (either of itself or taken together with anything else) to the investigation of any offence a person has committed or is reasonably suspected of having committed: Police Force Ordinance (Cap 232) s 50(6). Property seized in the exercise of this power may only be used for public purposes related to the investigation and prosecution of crime: Ho Shau-hong v Cmr of Police [1987] HKLR 945, CA; Hellewell v Chief Constable of Derbyshire [1995] 4 All ER 473, 1 WLR 804. In relation to landlord and tenant, the movable property found in or upon the house or premises mentioned in a warrant of distress for arrears of rent, and in the apparent possession of the person from whom the rent is claimed (ie the debtor), or such part thereof as may be sufficient to cover the amount of the rent, together with the costs of the distress, may be seized by a bailiff: Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 87.
