| 释义 | 撤銷申訴證明書 A certificate issued by a magistrate stating the complaint in any case of assault or battery was dismissed after hearing upon the merits: Offences Against the Person Ordinance (Cap 212) s 37. Certificate of dismissal releases a defendant from any other proceeding: s 38. In order to lay claim to a release of liability under s 38, the criminal proceedings against the defendant must be ‘preferred by or on behalf of the party aggrieved’: Chan Chung Lop v Chan Yun Sun [1999] 3 HKLRD 442 (CFI).
