What other people think of a person. Reputation is to be distinguished from character, which refers to a person’s actual traits: Plato Films Ltd v Speidel [1961] AC 1090, [1961] 1 All ER 876 (HL). The aim of defamation law is to protect a person’s reputation. A person’s reputation is not confined to his general character and standing but extends to his trade, business or profession, and words will be defamatory if they impute lack of qualification, knowledge, skill, capacity, judgement or efficiency in the conduct of his trade, business or professional activity: Drummond-Jackson v British Medical Assn [1970] 1 All ER 1094, 1 WLR 688 (CA). A person is entitled to sue for defamatory statements which damaged his reputation: Ratcliffe v Evans [1892] 2 QB 524. In evidence law, reputation must be treated as a fact, and not as a statement or multiplicity of statements dealing with the matter reputed: Evidence Ordinance (Cap 8) s 54(3)(b).
