Any person who has entered into a contract of employment to employ any other person as an employee and the duly authorised agent, manager or factor of such first mentioned person: Ng Kam Chun (t/a Chun Mou Estate Agency Co) v Chan Wai Hing Janet (HCA 3036/92, unreported); Chan Sik Pan v Wylam’s Services Ltd [2000] 1 HKLRD 687, [2001] 4 HKC 1 (CFA); Halsbury’s Laws of Hong Kong, Vol 10, Employment [145.016]. 2. In relation to a registered seafarer, the employer is the person who has supplied that seafarer for employment, or employed that seafarer, in a ship, irrespective of whether that person owns, charters or manages; or acts as an agent for another person who owns, charters or manages, that ship. In respect of any other seafarer, the employer is the person who is, in accordance with the crew agreement or other agreement for employment entered into by the seafarer for employment as a seafarer, specified, either by name or by necessary implication, as the employer of that seafarer: Merchants Shipping (Seafarers) Ordinance (Cap 478) s 2. 3. The Government and any body of persons corporate or unincorporate and the legal personal representative of a deceased employer, and, where the services of an employee are temporarily lent or let on hire to another person by the person with whom the employee has entered into a contract of service or apprenticeship, the latter shall, for the purposes of the Employees’ Compensation Ordinance, be deemed to continue to be the employer of the employee whilst he is working for that other person; and in relation to a person engaged, employed or paid through a club or hostel, the manager or members of the managing committee of the club or hostel shall, for the purposes of this Ordinance, be deemed to be the employer: Employees’ Compensation Ordinance (Cap 282) s 3.
