A standard of proof. In criminal proceedings a court must not find the charge proved if it is not satisfied beyond reasonable doubt that the accused committed the offence charged: Woolmington v DPP [1935] AC 462. Expressions like ‘100% certainty’ and ‘mathematical certainty’ should be avoided: R v Yeung Kuen Chi & Anor [1984] HKLR 447 (CA). An alternative is to tell the jury that they must be satisfied so as to be sure: Walters v R [1969] 2 AC 26. It was wrong to make a distinction between ‘sure’ and ‘certain’: R v Lee Yuk Wah & Ors [1985] HKLR 193 (CA). The implication of the requirement is that the accused is presumed to be innocent and entitled to be acquitted if the prosecution has not established guilt beyond reasonable doubt.
