释义 | 競投 In relation to an auction, an offer for property, the bidder being the offeror: AGC (Advances) Ltd v McWhirter (1977) 1 BPR 9454. In an auction, the sale is complete when the auctioneer announces its completion by the fall of the hammer, or any other customary manner: Sale of Goods Ordinance (Cap 26) s 60. Until such announcement is made, any bidder may retract his bid. Normally, the bidder is the offeror and a bid may be withdrawn before acceptance such as the falling of the hammer: Payne v Cave (1789) 3 Temp Rep 148; 100 ER 502. The onus is on the bidder to make an effective bid, being one communicated to the auctioneer: Richards v Phillips [1968] 2 All ER 859, [1969] 1 Ch 39 (CA). When a bid is accepted by an auctioneer, the offer is converted into an oral contract for sale between the seller and the bidder: Phillips v Butler [1945] Ch 358.
