| 释义 | 共同基金 Where costs are awarded by or under The Rules of the High Court (Cap 4A) or any order or direction of the court to a party to any proceedings either to be paid by another party to those proceedings or out of any proceedings either to be paid by another party to those proceedings or out of any fund (other than a fund which the party to whom the costs are to be paid holds as trustee or personal representative), the court may in any case in which it thinks fit to do so order or direct that the costs be taxed on the common fund basis: The Rules of the High Courts (Cap 4A) O 62 r 28(1), (3). This basis of taxation allows a reasonable amount in respect of all costs reasonably incurred and is more generous than the party and party basis: O 62 r 28(4).
