Usually referred to as party wall in the Hong Kong context. 1. In its loose sense the term is sometimes used simply to refer to a wall which is located along the boundary of two adjoining properties. It may or may not straddle the two properties. A party wall is therefore the same as a boundary wall. In its stricter sense, however, the term is reserved for only a wall which straddles the lands of different owners and normally the ownership of such a wall would be severed vertically between the two owners with half of the wall being owned by the owner of the property on one side and the other half being owned by the owner of the property on the other side, and there would be mutual rights of support and user in favour of the other. 2. A ‘party wall’ as ‘a load-bearing wall’, forming part of a building used or constructed to be used for the purpose of separating adjoining buildings; and which extends continuously from the floor level of the lowest floor or the building up to the underside of the roof, and from an external wall to the external wall opposite; and which has no door, doorway, arch, archway, window or other opening constructed in it: Buildings Ordinance (Application to the New Territories) Ordinance (Cap 121) s 2(1).
1. 一般指位處兩座相鄰財產或住宅之間的界線上的牆壁,不論是否橫跨該兩座財產或住宅。因此,共用牆即分界牆。但嚴格來說,共用墻只指橫跨不同業主的土地的墻,該墻的擁有權可被垂直劃分予該兩位業主,即當中一位業主擁有該墻的一半,而另一位業主則擁有該墻的另一半,相互支持權及使用權將會惠及另一方。 2. 「共用牆」指情形如下的承重牆:構成建築的一部份,用以分隔鄰樓的建築物或為此而建造的;及連續延伸的墻,即由建築物的最低層的樓面連續延伸至屋頂底面、與及由一道外墻連續延伸至對面外墻;及沒有門、門道、拱門、拱道、窗或其他通口在其上建造的牆:《建築物(新界適用)條例》(第121章)第2條第1款。
