释义	消極責任 In the context of the granting of an injunction to restrain a breach of contract, a promise by which mere inactivity on the part of the defendant constitutes performance. Where the promise is to act for the benefit of the plaintiff, but naturally implies a negative promise not to so act for the benefit of a third party, an injunction restraining breach of the promise is available: Warner Bros Pictures Inc v Nelson [1936] 3 All ER 160, [1937] 1 KB 209. A party who has committed a breach of a negative obligation may be ordered to take action to restore the status quo: Shepherd Homes Ltd v Sandham [1970] 3 All ER 402, [1971] Ch 340. Also known as ‘negative obligation’.
