释义 | 設計/外觀設計 A visual plan of an object or structure to be executed. Building and construction - The description of work to be done, including the materials to be used and even the manner of performance. Design may relate to a whole building or to some particular part; it may be very specific or minimal, leaving it to the contractor to work out the details. Commonly in the case of a design and construct contract the proprietor provides a preliminary design brief within which the contractor is free to work in order to achieve the contractual objective. Generally, ‘design’ connotes what the contractor is required to complete, not how he is to do it; this will depend, however, on the contract documents in any particular case: Thorn v London Corp (1876) 1 AC 120 (HL). The building contract may provide for the allocation of responsibility for the design of the works. An obligation as to design is frequently no more than the obligation to complete so that the works are fit for their purpose. The contractor may be liable to the employer for a defective design produced by a third party: Independent Broadcasting Authority v EMI Electronics Ltd and BICC Construction Ltd (1980) 14 BLR 1 (HL). Intellectual Property - Features of shape, configuration, pattern or ornament applied to an article by any industrial process, being features which in the finished article appeal to and are judged by eye, but does not include a method or principle of construction; or features of shape or configuration of an article which are dictated solely by the function which the article has to perform or are dependent upon the appearance of another article of which the article is intended by the designer to form an integral part: Registered Designs Ordinance (Cap 522) s 2(1). The article must have an eye-appeal which is created by a distinctiveness of shape, pattern or ornamentation calculated to influence the customer’s choice. Assuming that it has eye-appeal, the second part is that it has to perform, even if the same function could equally well be performed by an article of different shape: Interlego AG v Tyco Industries Inc [1989] AC 217l, [1988] 3 All ER 949, 2 HKLR 509, RPC 343; 3 WLR 678, 132 Sol Jo 698.
