释义	人道理由 Used to describe grounds or causes intended to advocate a/nd promote human welfare, rights and dignity, and humane action, the denial of which would be inhumane according to the ordinary views of humanity. It is a ground to be considered by the court in criminal sentencing: A-G v Tam ShekChuen & Anor [1992] 1 HKCLR 266 (CA). This may include unexpected disaster, such as the severe illness of a close relative of the illegal immigrant, occurs after the immigrant has arrived in Hong Kong: R v Kwok Hau Ching (HCMA 389/94, unreported). 用於意圖主張及促進人民福祉、人權及尊嚴，及人類行為的理由或原因，而根據人類的普遍的觀點，否認人道理由是不人道的。法庭在作出刑事判刑時亦須顧及人道理由：A-G v Tam ShekChuen & Anor [1992] 1 HKCLR 266（上訴法庭）。人道理由包括突發災禍，例如非法入境者在到達香港後，其近親病重：R. v Kwok Hau Ching（高院裁判法院上訴1994年第389號，未經彙報）。
