The last name or family name which a child is given at birth. According to Chinese customs, generally a child’s surname is the same as his or her father. However, in the west a child can be given a combination of the father’s and the mother’s surnames, ie a double barrel surname. In the event of conflict, the Family Court has the power to either sanction or restrain the change of a child’s surname: In the Marriage of Palmer and Chapman (1978) 34 FLR 405. The issue often arises after separation when the mother takes a new surname and wishes the child to adopt her new surname. In deciding such cases the court considers the best interests of the child as the paramount consideration and looks at such matters as confusion of identity for the child, the effect of a change of surname on the child’s relationship with his or her parents, and the general advantages and disadvantages to the child of a change: In the Marriage of Palmer and Chapman, supra.
