释义 | 批予效力的減損 Action by a grantor that denies or countermands a central element of the grant of a property right. A grantor cannot refuse the grantee something that is obviously necessary for the reasonable enjoyment of the grant. An example is where a grantor grants or leases land to be used for a specific purpose and then does something that prevents the land from being used for that purpose, in such a case, the law will not allow the grantor to derogate from the grant. Also known as ‘non-derogation principle’ or ‘principle of non-derogation from grant’. See also Derogation; Easement of necessity; Grantee; Grantor. 指批地人否認或撤銷財產權利授予的主要元素的行為。批地人不可拒絕給予獲批地人為合理地享用有關授予而明顯所需的東西。例如凡批地人為特定用途而批地或租地後,作出若干行為使有關土地不能用作該用途,在此等情況下,法律不會容許批地人減損批地的效力。另稱「不減損原則」或「批予效力不減損原則」。另見 Derogation; Easement of necessity; Grantee; Grantor。 |
