释义 | 安全的工作地方 A place of employment as free from danger as the nature of the work permits and in which the exercise of reasonable care should remove or guard against danger. An employer has a duty to an employee to take such reasonable care, precautions, and safeguards as ordinary experience, prudence, and foresight suggest are necessary to provide and maintain a working environment for all persons employed by the proprietor at the industrial undertaking that is, so far as is reasonably practicable, safe, and without risks to health: Factories and Industrial Undertakings Ordinance (Cap 59) s 6A(2)(e); R v Tsui Wai Ping [1993] 2 HKC 675. This does not require an absolute elimination of danger, but of all danger which can be avoided with the exercise of reasonable care: Naismith v London Film Productions Ltd [1939] 1 All ER 794; Wong Wai Ming v Hospital Authority [2000] 4 HKC 330. It is the employer’s duty to see that his employee is not exposed to unnecessary risks: Cheung Suk Wai v A-G [1996] 4 HKC 288; Lai Chi Pon v Toto Steel and Iron Works Ltd [1997] 2 HKC 195. An employer could be in breach of his duty to provide a safe place of work where he fails in his duty to insure safety of his employees working on platforms on a construction site at a certain height (Choi Mei Ho v Chung Chiu Ying (t/a Kin Kee) [1997] 2 HKC 706) or to provide suitable machines and adequate training or supervision (Lee Ting Sang v Chung Chi-Keung [1990] 1 HKLR 764, 2 AC 374 (PC) ).
