释义 | 法定抵銷 The reduction of the defendant’s debt due to the plaintiff by the amount of the plaintiff’s indebtedness to the defendant. A legal set-off is confined to debts which at the time when the defence of set-off is filed are due and payable and either liquidated or in sum capable of ascertainment without valuation or estimation: Japan Leasing (HK) Ltd (In Liq) v Shun Kai Finance Co Ltd [2001] 2 HKC 179 (CFI). Also known as ‘set-off at law’. See also Banker’s lien; Counterclaim. 被告人對原告人負有的債項因原告人對被告人也負有的債項而相應減少。法定抵銷只限制於當抵銷抗辯已提交的債項已到期及應繳付,在沒有估值及作評估的情況下,被結束或可被確定:Japan Leasing (HK) Ltd (In Liq) v Shun Kai Finance Co Ltd [2001] 2 HKC 179 (高等法院原訴庭)。另稱「在法律上受抵銷」。另見 Banker’s lien; Counterclaim。 |
