释义 | 剝奪權利的條款 A statutory provision which purports to prohibit judicial review of the decision making power of a tribunal or inferior court. However, ouster clauses must be construed strictly and the jurisdiction of the court to review should not be whittled down except by clear and comprehensive language: Chan Yik Tung v Hong Kong Housing Authority [1989] 2 HKC 394 (HC). Also known as ‘privative clause’. See also Privative clause. 本意為禁止對審裁處或下級法院的作出決定權力要求司法覆核的法定規則。但必須嚴格地解釋剝奪權利的條款,除非經清晰及全面的文字,否則法院的覆核管轄權不應被削弱:Chan Yik Tung v Hong Kong Housing Authority [1989] 2 HKC 394 (高等法院)。另稱「剝奪條款」。另見 Privative clause。 |
