Regular financial responsibilities incidental to the use of real property, such as rates, rent, repairs and the ordinary expenses of cultivating or managing the property but also expenses which are, in general, charged on the property. Payments which the purchaser would have to meet if completion had taken place; in the case of a contract to grant a lease, it includes the rent to be reserved by the lease, but in the case of a contract to grant an underlease it does not include the head rent which would continue to be payable to the vendor: Vangeen v Benjamin (1976) 239 EG 647. In a formal contract it is usually provided that the vendor is to pay all the outgoings until the day fixed for completion, and that for this purpose all necessary apportionments are to be made: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0259]. Outgoings do not include a charge or levy upon an owner rather than upon the property: Allum v Dickinson (1882) 9 QBD 632. Outgoings are usually payments but need not be and can include acts to be done: Brett v Rogers [1897] 1 QB 525. The extent of the payments which are incidental will be subject to the intention of the parties to any agreement: Foulger v Arding [1904] 1 KB 700; Lowther v Clifford [1927] 1 KB 130.
