释义 | 衡平法上的租契 A lease arising by virtue of the doctrine in Walsh v Lonsdale (1882) 21 Ch D 9 and the maxim that equity considers done that which ought to have been done. An agreement for a lease will be treated by a court of equitable jurisdiction as an equitable lease for the term agreed upon, and, as between the parties, as the equivalent of a lease at law: Chan v Cresdon Pty Ltd (1989) 168 CLR 242. To be an equitable lease, an agreement for a lease must be capable of specific performance. An equitable lease is liable to be defeated by a bona fide purchaser of the legal estate for value without notice of the equitable lease.
