释义 | 衡平法權益 An interest in property enforced and created by the Court of Chancery in England in the situation where it would have been unconscionable for the legal owner of the property to retain the benefit of the property for himself or herself. Usually the trustee had the legal estate in the trust property but held for the beneficiaries who possessed the equitable interests: Hardoon v Belilios [1901] AC 118 (PC). Equitable interests developed from the ‘right in personam’ to an actual ‘real right’, which can be exercised against the trustees. A life tenant has an interest in the specific trust assets: Baker v Archer-Shee [1927] AC 844, 11 TC 764 (HL); Archer-Shee v Garland [1931] AC 212 (HL). Equitable interests are ‘hybrid’ interests which are in between jura in rem and jura in personam. Under the statute, ‘equitable interest’ means any estate, interest or charge in or over land which is not a legal estate or a freehold: Conveyancing and Property Ordinance (Cap 219) s 2.
