释义 | 不在犯罪現場 Lat – elsewhere. A claim by a person charged with an offence to the effect that he or she was somewhere other than the place where the crime was committed at the time of the commission of the offence and, therefore, could not be guilty of the offence. An accused person has the evidentiary onus in respect of an alibi: R v Johnson [1961] 3 All ER 969, 46 Cr App Rep 55, 1 WLR 1478 (CA). Where an alibi is raised, the prosecution has to negative the alibi beyond reasonable doubt: R v Tsang Kam Hing [1991] 1 HKC 72 (CA). A false alibi may not provide support for identification evidence, unless the sole reason for fabrication was to deceive the jury and no other explanation was put forward: R v Turnbull & Ors [1976] 3 All ER 549, 63 Cr App Rep 132, [1977] QB 224 (CA); Chan Hon Tong v R [1973] HKLR 216. The use of the word in the general sense ‘excuse’ is increasingly common but is not accurate.
