The right of an unpaid vendor who has parted with the possession of the goods to retake possession of goods sold while they are still in transit (that is, in the hands of the carrier), where the buyer is, or may become, insolvent: Sale of Goods Ordinance (Cap 26) ss 47-50. Once the goods have been regained the seller is entitled to retain them until the buyer pays or tenders the price: s 46. The right of stoppage in transitu is one available only against the goods themselves: Kemp v Falk (1882) 7 App Cas 573 (HL). It is therefore, for instance, not available against the proceeds of an insurance policy effected by the buyer against damage to the goods during the transit: Berndtson v Strang (1868) 3 Ch App 588.
