| 释义 | 偷渡者 A person who is (a) being on board any ship in the waters of Hong Kong with intent to obtain a passage therein without the consent of the owner and charterer, or their agents, of the ship; or (b) arriving in the waters of Hong Kong on board any ship, having obtained a passage therein to Hong Kong without the consent of the owner and charterer, or their agents, of the ship: Stowaways Ordinance (Cap 83) s 3. A person secretes himself for the purpose of being a carrier without the consent of either the operator or the commander thereof, or any other person entitled to give such consent: Air Navigation (Hong Kong) Order 1995 art 52. The onus of proving the consent of the owner shall lie upon the accused: Stowaways Ordinance (Cap 83) s 6. A stowaway commits an offence: s 8.
