释义 | 延期交貨 In sale of goods contracts, the tender of goods by the seller after the time appointed by the contract. The buyer is usually under no obligation to accept the goods, time of delivery being of the essence in commercial contracts. Damages for late delivery are available in common law: Vintech Co Ltd v Radio-Holland Hong Kong Ltd [2001] 3 HKLRD L4 (DC); Lee Yip Kun and Ors v The Chius Manufacturing Co Ltd [1976] HKLR 195 (CA). Prime facie the buyer may recover the difference between the market price of the goods at the time and place of actual delivery, and the market price when the goods ought to have been delivered: Wertheim v Chicoutimi Pulp Co [1911] AC 301 (PC).
