Late completion is a breach of contract, which gives rise to an entitlement to damages, which is often in the form of liquidated and ascertained damages, and may give rise to a right in the proprietor to terminate the building contract: Westminister Properties Pty Ltd v Comco Constructions Pty Ltd (1990) 2 WAR 335.
