释义 | 實際欺詐 At common law, deceit with an intention to deceive or reckless indifference as to the truth or falsity of a representation: Derry v Peek (1889) 14 App Cas 337 (HL). Mere carelessness will not constitute fraud at law: Angus v Clifford [1891] 2 Ch 449 (CA). The motive or object of the person making the representation is irrelevant: Edgington v Fitzmaurice (1885) 29 Ch D 459 (CA). Actual fraud is distinguished from equitable fraud, which focuses on the conscience and motives of the party.
