Deed of mutual covenant |
Abbr – DMC. A deed which regulates the rights and duties of the ‘owners’ of units in multi-storey buildings. It covers all aspects of co-ownership of the development, which will usually be a single multi-storey building, but often is a series of buildings, linked to each other by a podium. Apart from the shareholding of the owners, it contains various restrictive and positive covenants, personal rights, and other matters relevant to the management of land owned by many parties: Halsbury’s Laws of Hong Kong, Vol 16, Land [230.0437]. The deed of mutual covenant also recites the covenants in the Government lease to which all owners are subject, but compliance with which is usually a matter for the manager. Default in compliance with these covenants will render the land liable to forfeiture to the Government without compensation: Giant River Ltd v Asie Marketing Ltd [1990] 1 HKLR 297, [1986-88] CPR 543. |
