| 释义 | 家務能力的損失 An impairment of one’s ability to perform household chores. Such loss will be assessed on the basis of the cost of employing a housekeeper to perform them, even though the plaintiff may choose not to employ a housekeeper: Daly v General Steam Navigation Co Ltd [1980] 3 All ER 696, [1981] 1 WLR 120 (CA). Also, if, during the pre-trial period, the plaintiff’s spouse loses earnings in order to provide the domestic assistance required at home, then those earnings can properly be pleaded and claimed as special damages and such loss of earnings is deducted from what would otherwise have been the award in respect of general damages for loss of amenity relating to such loss of housekeeping capacity: Berry v Humm & Co [1915] 1 KB 627. Also known as ‘loss of housekeeping capacity’.
