Any lease granted by the Crown before 1 July 1997, any instrument whereby the term of a Crown lease may have been extended or the provisions thereof varied and any agreement for a Crown lease: Interpretation and General Clauses Ordinance (Cap 1) s 3. An example is a deed for the release of the rights of way reserved under the Crown lease relating to the properties: Guang Zhou Real Estate Development (HK) Co Ltd & Anor v Summit Elegance Ltd [2000] 2 HKLRD 855. However, where the deeds of release are not executed by the Government before the completion date but only comes into legal existence upon being executed by the Government, such deeds do not form part of the Crown lease. Accordingly, the purchaser is not entitled to such deeds upon completion since they are documents yet to be created, rather than documents already in existence: Guang Zhou Real Estate Development (HK) Co Ltd & Anor v Summit Elegance Ltd, supra. 2. An agreement to occupy or use Crown land usually in consideration for rent.
