释义 | 現代授權證書遺失原則 A legal fiction invented to allow creation of an easement by prescription where one cannot be established to the length of time required under common law. A presumption is made of the grant of the easement to the owner of the dominant tenement by the owner of the servient tenement in a deed made in more recent times after 1189, which has since been lost but had been long enjoyed pursuant to that grant. This method is not possible in Hong Kong as the user relevant to establish a prescriptive right to an easement must be a user by or on behalf of a fee simple owner against another fee simple owner: Chung Yeung Hung & Ors v Law Man Nga & Anor (t/a Constant Rich Investment Co [1997] 2 HKC 406, HKLRD 1022 (CA); Tang Tim Fat & Anor v Chan Fok Kei [1992] 2 HKC 623, [1993] 2 HKLR 373 (HC). Moreover, the Prescription Act 1832 (UK) no longer apply in Hong Kong as the Application of English Law Ordinance (Cap 88) has been in effect repealed.
