释义 | 訂立法例不適用的合約條款/同意不受法例約束 Terms expressly renounce or exclude the operation of certain statutory provisions that would otherwise affect the terms or performance of a contract. Contracting out is often prohibited, as it nullifies the benefits the statute is intended to confer. The contrary provision in the employment agreement to forfeit unused annual leave at the end of each year was regarded as to contract out rights, benefit or protection conferred upon an employee by the Employment Ordinance: Archer v Hong Kong Channel Ltd [1998] 1 HKC 307 (CA); Employment Ordinance (Cap 57) s 70. Save for express exception, any contract or agreement whereby an employee relinquishes any right to compensation from his employer for personal injury by accident arising out of and in course of his employment be null and void: Employees’ Compensation Ordinance (Cap 282) s 31.
