| 释义 | 共同海損 Abbr – GA. 1. Where any extraordinary sacrifice or expenditure voluntarily and reasonably made or incurred by a party in time of peril for the purpose of preserving the property imperilled in the common maritime adventure, the other parties whose properties have been preserved, subject to the conditions imposed by maritime law, are bound to make rateable contribution towards the party’s loss: Marine Insurance Ordinance (Cap 329) s 66. The conditions imposed by maritime law include the followings: a party, who is legally liable to the fault giving rise to the peril, will be precluded from recovering a general average contribution (The Carron Park (1890) 15 PD 203); the loss arising from a jettison of deck cargo is not general average, except where the cargo was carried on deck in accordance with the established custom of the trade or with the consent of all other owners of cargo in the common adventure: Strang, Steel & Co v Scott (A) & Co (1899) 14 AC 601. 2.
