| 释义 | 生存者取得權權利 A right in relation to property held under a joint tenancy, where on the death of one of the joint tenants, that person’s share in the property is absorbed into the shares of the surviving joint tenants. This means that no joint tenant except the last to die has any interest in the property which may be devised by will. Where all joint tenants die together, it may be necessary to resort to the rules of commorientes to determine which joint tenant was last entitled to the land, and into whose estate the land therefore falls. Also known as ‘jus accrescendi’.
