A witness who gives unfavourable evidence to a party, or does not appear to be making a genuine attempt to give evidence about a matter of which he or she may reasonably be supposed to have knowledge, or has made a prior inconsistent statement. A party calling an unfavourable witness is not allowed to impeach the witness’s credit by general evidence of bad character; but he may contradict the witness’s evidence by calling other witnesses to give evidence of those matters in relation to which the unfavourable witness failed to come up to proof: Evidence Ordinance (Cap 8) s 12. The party calling the unfavourable witness may adduce other evidence of the facts in question, not consistent with the unfavourable evidence, including, in civil cases (subject to certain conditions), the evidence of a statement made by that witness on another occasion: s 47. It is then a matter for the judge or jury to decide where the truth lies: Bradley v Ricardo (1831) 8 Bing 57. See also Cross-examination; Hostile witness; Prior inconsistent statement.
