| 释义 | 續訂令狀 The extension of the validity of a writ by the court on a motion made while a writ is valid. A writ is valid in the first instance for 12 months beginning with the date of its issue for the purpose of service: The Rules of the High Court (Cap 4A) O 6 r 8(1). Where a writ has not been served on a defendant, the court may by order extend the validity of the writ from time to time for such period, not exceeding 12 months at any one time, beginning with the day next following that on which it would otherwise expire, as may be specified in the order, if an application for extension is made to the Court before that day or such later day (if any) as the Court may allow: O 6 r 8(2). Application is made ex parte to a master supported by affidavit and accompanied by the original writ. Lee Fai (t/a Fai Kee Timber) v Chan Kui [1997] 3 HKC 228, HKLRD 1154 (CA). Renewal without application is an irregularity which does not necessarily invalidate the renewal: Bugden v Ministry of Defence [1972] 1 All ER 1, 1 WLR 27 (CA).
