释义 | 悔意 Contrition or shame. In sentencing the fact that the accused is genuinely remorseful for having committed the offence may be taken into account by the court as a mitigating factor. The extent to which it is relevant in a particular case varies: HKSAR v Tong Fuk Sing [1999] 3 HKLRD 710, 3 HKC 332 (CA). Remorse can be evidenced in a number of ways prior to sentencing, for example, by providing substantial assistance to the authorities in the investigation or prosecution of the offences: A- G v Mutton (CAAR 8/91, unreported). This may appear in various forms such as apology, admission of the offence to the investigating authorities (A-G v Lui Kam Chi [1993] 1 HKC 215 (CA)), voluntary surrender to the authorities (R v So Man-king [1989] 1 HKLR 142 (CA)) restitution to the victim of sums gained from the crime (S-J v Hui Siu Man [1999] 2 HKLRD 236 (CA), as well as the plea of guilty itself (R v Ng Po Wah [1996] 1 HKC 457 (CA)). A person of clear record, from a stable background, who has shown remorse and is unlikely to re-offend is likely to be eligible for a community service order: R v Clarke (Linda) [1982] 3 All ER 232, 1 WLR 1090 (CA).
