释义 | 補救 Making amends for injury or wrong done, often by the payment of compensation. Criminal law - See Compensation order. Foreign relations - The obligation of a state to compensate for an injury it has caused to another state or international organisation as a result of violating international law. Reparation is a separate obligation from the primary obligation not to commit any wrongful act: Chorzow Factory Case (Germany v Poland), Merits 1928 PCIJ ser A No 17; Reparation for Injuries Suffered in the Service of the United Nations Case 1949 ICJ 174. The aim of reparation is to restore the situation which would have prevailed in the absence of the wrongful act. It may take the form of restitution for property illegally taken, compensation, indemnity, and satisfaction. The International Court of Justice has jurisdiction over disputes concerning the nature and extent of reparation: Statute of the International Court of Justice 1945 art 36 para 2.
