A covenant in a lease which confers upon a tenant an immediate term with a right to the further term if so required by the tenant, at the end of the term or at some stated period within the term: Muller v Trafford [1901] 1 Ch 54. It differs from a variation of an existing lease by extending its term because a renewal of lease includes a termination the earlier lease and the granting of a new lease: Regor Regor Estates Ltd v Wright [1951] 1 KB 689. In the event of the death of the tenant within the term this right devolves upon his personal representatives, and will run with the land and the reversion: Muller v Trafford, supra. If the covenant requires that the lease should be renewed so far as possible on the same clauses, the landlord is not bound to grant renewal of the lease if the circumstances make it become impossible to renew on the same terms as the original lease: Hollies Stores Ltd v Timmis [1921] 2 Ch 202. The tenant must give notice of his intention to take a renewal before the determination of the term otherwise he would lose his right: Bayley v Leominster Corpn (1792) 1 Ves 476; Nicholson v Smith (1882) 22 Ch D 640. However, a notice given an unreasonable time in advance, ie 34 years, may be ineffective: Biondi v Kirklington and Piccadilly Estates Ltd [1947] 2 All ER 59.
