| 释义 | 推翻定罪 Setting aside a conviction, finding of guilt or sentence. Where the court quashes an order of justices, other convictions based on that order may be quashed even when the applicant has pleaded guilty: R v Middleton, Bromley and Bexley Justices, ex p Collins [1970] 1 QB 216, [1969] 3 All ER 800 (DC). If the appeal against conviction is allowed, the conviction must be quashed: Criminal Procedure Ordinance (Cap 221) s 83(2). The order quashing the conviction operates as a direction to the court of trial to enter a judgment and verdict of acquittal unless a re-trial is ordered: s 83(3).
