释义 | 再管有權 The taking of possession of something that is the subject of a contract, by a person who has a right to possession of that thing on a breach of the contract. For example, the right of a financier to regain possession of a thing sold under a consumer credit contract where there is a failure to make all required payment: Citicorp Commercial Finance (HK) Ltd v Tong Lai Sing Daniel [1997] 1 HKC 406. A mortgagee of goods has a right to repossess the goods subject to mortgage but must do so only in accordance with a court order. A mortgagee of land has a right to possession (not strictly repossession) on the mortgagor’s default.
