In contract law, an oral or written statement, made by one party (the representor) to another party (the representee), relating to a past event or existing fact, by way of affirmation, denial, description or otherwise, which induces a course of action such as entry into a contract. It may be a representation of fact even though it involves and includes that which is also a matter of law: Moorgate Mercantile Co Ltd v Twitchings [1976] QB 225, [1975] 3 All ER 314 (CA). 2. The substitution of one person for another by standing in their place for particular purposes. An agent represents his or her principal, an executor his or her testator, and an heir his or her ancestor. 3. The entitlement of a person to have another stand in his or her place to act for him or her legally, for example, for the purpose of presenting a case in court. The Hong Kong Bill of Rights guarantees that an accused person may defend himself through legal assistance of his own choosing: Hong Kong Bill of Rights Ordinance (Cap 383) s 8 art 11(2)(d).
