| 释义 | 獨立創作 In copyright law, a work displaying substantial similarities to a copyright item, but which was not derived, either directly or indirectly, from that item, and which therefore does not infringe copyright in that item: Francis, Day & Hunter Ltd v Born [1963] 1 Ch 587; Dr Lam Tai Hing v Dr Koo Chih Ling Linda & Anor [1993] 2 HKC 1 (CA). In assessing evidence of independent development of a work, the court will take into account whether it is likely that the defendant deliberately set out to cut corners and to appropriate the benefit of the plaintiff’s work by copying essential features.
