In negligence law, the courts have tended as a matter of policy to deny the existence of liability in areas where it would appear difficult to limit the potential plaintiffs to which a negligent defendant may be liable: Ultramares Corp v Touche [1931] 174 NE 441. This is particularly so with regard to pure economic loss, although there are exceptional cases where recovery will be permitted.
