释义 | 獨立的司法機構 The status of a judicial branch disempowered from interfering with, and protected from interference by, the executive and legislative branches, subject to constitutional checks and balances in a system of government based on the separation of powers doctrine. The Hong Kong SAR is vested with independent judicial power, including that of final adjudication: Basic Law art 19 para 1. The role of an independent judiciary is to ensure that if citizens’ rights are infringed by a government department according to the law, and if the infringement is unlawful, it is for the judiciary to declare it to be so: Re Sakchai Suwannapeng [1990] 2 HKLR 231 (HC).
