| 释义 | 彌償保險 An insurance where the insured will be indemnified by the insurer for his or her actual loss, that is, placed in the position he would have been in had the loss not occurred: Castellain v Preston (1883) 11 QBD 380 (CA). Indemnity insurance covers most insurance contracts except life insurance, sickness and personal accident insurance. The insurer’s obligation to indemnify only arises when loss has actually been suffered by the insured: British Cash and Parcal Conveyors Ltd v Lamson Store Service Co Ltd [1908] 1 KB 1006 (CA). Indemnity can be subject to any limitations agreed by the parties such as the deductible average or policy limit.
