A will made with a clearly expressed intention that it shall become operative only on the happening, or not happening, of a specified event or a contingency. A conditional will is valid only if the condition appears in the will itself: Halsbury’s Laws of England (4th Ed) Vol 50, para 255 et seq. A conditional will is of no effect if the contingency fails: Re Robinson (1870) LR 2 P&D 171. However, it may take effect free from the contingency concerned if re-executed or republished after the contingency has passed: Parsons v Lanoe (1748) 1 Ves Sen 189. If the possibility of an event happening is stated merely as the reason for making the will, the will is not conditional and becomes operative whether the event happens or not.
