释义 | 不真誠 Dishonesty or unconscionability. Bad faith does not include an honest though mistaken belief: Cannock Chase District Council v Kelly [1978] 1 All ER 152, 1 WLR 1 (CA): Halsbury’s Laws of England (4th Ed), Vol 9(1), para 612. Administrative Law - Where an administrative power is exercised for the promotion of a purpose, not being a purpose for which the power was conferred, the exercise of such power for the ulterior purpose is an act of bad faith: Halsbury’s Laws of Hong Kong, Vol 1, Administrative Law [10.069]. Bad faith must be expressly pleaded and particularised: The Rules of the High Court (Cap 4A) O 18 r 12(1); Cannock Chase District Council v Kelly [1978] 1 WLR 1. Contract - Where a promisor is subject to an express or implied obligation of good faith, performance in bad faith constitutes a breach of contract. However, performance which is in accordance with the contract, but rendered in bad faith, does not constitute a breach.
