| 释义 | 追溯 To put an earlier date on; to apply retrospectively. Insurance - To make an insurance policy valid from the time that interim cover commences. Regarding insurance claims that arise during the period of interim cover, a backdated policy should be disregarded to the extent of any inconsistency with the original agreement. Sentencing - To take into account time spent by a prisoner in custody on remand pending the determination of an offence by dating the sentence imposed in respect of that offence to commence from a time prior to the date of sentence so as to credit the prisoner with the time already served by reason only of that offence. However, in Hong Kong, the courts have no jurisdiction to order a sentence of imprisonment to begin at a time earlier than the date of its pronouncement: A-G v Wong Man Kei [1992] 2 HKC 52 (CA); R v Fan Ah Yuk [1961] HKLR 665. The law provides an alternative to backdating by giving a benefit for the time served by reducing the sentence by an equivalent amount: Criminal Procedure Ordinance (Cap 221) s 67A.
